This Legal Notice regulates the access, navigation and use of www.institutoautor.org (hereinafter, the WEBSITE) and implies the express and unreserved acceptance of all the terms, having the same validity and effectiveness as any written and signed contract.

Its observance and compliance will be enforceable with respect to any person accessing, navigating or using the WEBSITE. If you do not agree with the terms set out in the Legal Notice, do not access, navigate or use any page of the WEBSITE.

2. USE OF THE WEBSITE

The INSTITUTO AUTOR’s WEBSITE allows access to informative materials, news, monthly newsletters, and information about the INSTITUTO AUTOR’s past and current activities and projects (hereinafter, the CONTENT).

The WEBSITE also provides an Online Public Access Catalogue of the library of the INSTITUTO AUTOR, specialised in intellectual property and cultural industries (hereinafter, the LIBRARY), as well as an electronic booking system for accessing the INSTITUTO AUTOR’s headquarters in order to consult the works contained in the LIBRARY, which is made up of the following collections:

  • Ramón Casas Vallès Library.
  • General Fund.
  • Publications of the INSTITUTO AUTOR

3. PURPOSE AND SCOPE OF APPLICATION

This Legal Notice regulates access, navigation and use of the WEBSITE, without prejudice to the fact that the INSTITUTO AUTOR reserves the right to modify the presentation, configuration and content of the WEBSITE, as well as the conditions required for its access and use. Access to and use of the Contents of the WEBSITE after the entry into force of its modifications or changes implies acceptance of these.

However, access to certain content and the use of certain services may be subject to certain specific conditions, which will, in any case, be clearly displayed and must be expressly accepted by users. These particular conditions may replace, complete or, where appropriate, modify these general conditions of use.

The INSTITUTO AUTOR reserves the right to modify the terms and conditions stipulated herein, totally or partially, publishing any change in the same form in which these conditions of use appear or through any type of communication addressed to users.

4. ACCESS

Access to and navigation of the WEBSITE is, unless otherwise indicated, free of charge and does not require registration. Access to and use of the WEBSITE implies that the USER of the WEBSITE undertakes to comply fully with this Legal Notice, as well as with the instructions or recommendations indicated in each specific case through the WEBSITE.

4.1. REQUIREMENTS FOR REGISTRATION TO ACCESSING THE LIBRARY

In order to access the INSTITUTO AUTOR LIBRARY catalogue, you must be of legal age.

5. LINKS

In the event that the WEBSITE shows different buttons, links, banners, embedded content, etc., the INSTITUTO AUTOR informs that these may be directly managed by third parties and that the INSTITUTO AUTOR is not responsible for the contents published therein. The links that this WEBSITE may contain are offered solely as informative references, the purpose of which is to facilitate access to other contents that are deemed of interest.

Consequently, the INSTITUTO AUTOR cannot assume any type of responsibility for any aspect relating to the web page to which a link may be established from the WEBSITE, specifically, but not limited to, its operation, access, data, information, files, quality and reliability of its products and services, its own links and any of its contents, in general.

The INSTITUTO AUTOR may make available to users, through different tools and applications, links that allow users to access the WEBSITE channels and pages that the INSTITUTO AUTOR maintains on different platforms and social networks belonging to or managed by third parties (e.g. Facebook, Twitter, Instagram, YouTube, LinkedIn, etc.). The inclusion of these links on the WEBSITE has the sole purpose of providing users with access to these channels.

In any case, the establishment of any type of link from the WEBSITE to another external website does not imply that there is any type of relationship, collaboration or dependence between the INSTITUTO AUTOR and the party responsible for the external website.

6. LINKS ON OTHER WEB PAGES TO THE WEB SITE

The INSTITUTO AUTOR does not authorise the establishment of a link to this WEBSITE from other web pages that contain materials, information or contents that are illicit, illegal, degrading, obscene and, in general, that contravene the law, morality or public order, or generally accepted social norms.

In any case, users may establish links on their respective web pages as long as they request prior and express authorisation from INSTITUTO AUTOR.

7. INTELLECTUAL PROPERTY RIGHTS

The INSTITUTO AUTOR is the owner or, where applicable, has the corresponding licences for the exploitation rights of the intellectual property of this WEBSITE, as well as the intellectual property rights over the information, materials, and contents of the same.

Under no circumstances shall it be understood that access, navigation, and use of the WEBSITE by the user implies a resignation, transmission, licence or total or partial transfer of said rights on the part of the INSTITUTO AUTOR. The user has the right to use the contents and services of the WEBSITE within a strictly domestic environment.

References to registered trademarks or trade names, or other distinctive signs, whether owned by INSTITUTO AUTOR, the SGAE Group (Sociedad General de Autores y Editores, Fundación SGAE and Instituto Autor) or third party companies, imply a prohibition on their use without the consent of INSTITUTO AUTOR or their legitimate owners. At no time, unless expressly stated to the contrary, does access, navigation or use of the WEBSITE and its contents, confer on the user any right whatsoever over the distinctive signs included therein.

All intellectual property rights over the contents and services of the WEBSITE are reserved and, in particular, it is forbidden to modify, copy, reproduce, publicly communicate, transform or distribute, by any means and in any form, all or part of the contents included in the WEBSITE, for public or commercial purposes, without the prior, express and written authorisation of INSTITUTO AUTOR or, where appropriate, of the holder of the corresponding rights.

In the event that the user sends information of any kind to the INSTITUTO AUTOR through any of the channels provided for this purpose, the user declares, guarantees and accepts that has the right to do so freely, that said information does not infringe any intellectual property rights, trade secrets or any other rights of third parties, and that said information is not confidential or harmful to third parties.

The user recognises that assumes responsibility, leaving the INSTITUTO AUTOR unharmed for any communication that provides personally or in name, with this responsibility covering without restriction the accuracy, legality, originality and ownership of the same.

8. CONDITIONS OF USE OF THE WEBSITE

Access to or use of the WEBSITE for illegal or unauthorised purposes, with or without economic purpose, is not permitted and, more specifically and without the following list being absolute, it is prohibited, and therefore its consequences shall be the sole responsibility of the user:

  • Use the WEBSITE in any way that may cause damage, interruptions, inefficiencies or defects in its functionality or in the computer of a third party;
  • Use the WEBSITE for the transmission, installation or publication of any virus, malicious code or other harmful programmes or files;
  • Use the WEBSITE to collect personal data of other users;
  • Registering through the WEBSITE under a false identity, impersonating a third party or using a profile or performing any other action that may mislead other users as to the identity of the origin of a message;
  • Breaking, or attempting to break, the security or authentication measures of the WEBSITE or any network connected to it, or the security or protection measures inherent to the content offered on the WEBSITE;
  • Carry out any action that causes a disproportionate or unnecessary saturation in the infrastructure of the WEBSITE or in the systems or networks of the INSTITUTO AUTOR, as well as in the systems and networks connected to the WEBSITE; or
  • Impede the normal development of an event, competition, promotion or any other activity available through the WEBSITE or any of its functionalities, either by altering or attempting to alter, illegally or in any other way, access, participation or operation of the same, using fraudulent methods of participation, by any procedure, or through any practice that violates or infringes in any way this Legal Notice.

Failure to comply with any of the above obligations by the User may lead to the adoption by the INSTITUTO AUTOR of the appropriate measures protected by law and in the exercise of its rights or obligations and may lead to the elimination or blocking of the offending user’s account, without the possibility of any compensation for the damages caused.

9. RESPONSIBILITIES AND GUARANTEES

The INSTITUTO AUTOR cannot guarantee the reliability, usefulness or veracity of absolutely all the information and services of the WEBSITE, nor the usefulness or veracity of the documentation made available through it.

Consequently, the INSTITUTO AUTOR neither guarantees nor accepts responsibility for: (i) the continuity of the contents of the WEBSITE; (ii) the absence of errors in said contents; (iii) the absence of viruses or other harmful components in the WEBSITE or in the server that supplies it; (iv) the invulnerability of the WEBSITE and the impossibility of breaching the security measures adopted therein; (v) the lack of usefulness or performance of the contents of the WEBSITE; and (vi) the damage or harm caused, to themselves or to a third party, by any person who infringes the conditions, rules and instructions that the INSTITUTO AUTOR establishes on the WEBSITE or through the violation of the security systems of the WEBSITE.

Nevertheless, the INSTITUTO AUTOR declares that it has adopted all the necessary measures, within its possibilities and the state of the art, to guarantee the functioning of the WEBSITE and to reduce system errors to a minimum, both from a technical point of view and in terms of the content published on the WEBSITE.

If the user becomes aware of the existence of any content that is illicit, illegal, contrary to the law or which could involve an infringement of intellectual property rights, of the applicable regulations on the protection of personal data or any other right, it must notify INSTITUTO AUTOR immediately so that it can proceed to adopt the appropriate measures.

In any case, the INSTITUTO AUTOR reserves the right to suspend, modify, restrict or interrupt, temporarily or permanently, access, navigation, use, hosting and downloading of content and use of WEBSITE services, with or without prior notification, to users who contravene any of the provisions detailed in these conditions of use, without the user being able to claim any compensation for this reason.

10. PRIVACY POLICY AND COOKIES

In accordance with the provisions of current and applicable legislation on the protection of personal data, all personal data provided during the use of the WEBSITE will be treated in accordance with the provisions of the Privacy Policy that all users must expressly accept in order to be able to use and access the services of this WEBSITE.

11. APPLICABLE LAW AND COMPETENT JURISDICTION

This legal notice shall be governed by current Spanish legislation and any dispute shall be submitted to the Courts and Tribunals of the city of Madrid.
