Artificial Intelligence and New Digital Exploitations Observatory

A space for identifying and studying the developments of generative artificial intelligence (GAI) and its corresponding impact on intellectual property rights.

The Observatory will focus on the specific and ongoing analysis of both the advances in GAI and its impact on IP rights, as well as policies, regulatory and legislative initiatives, registration and protection decisions, court rulings, licensing agreements, studies, reports, etc., in a comparative context, related to this complex interaction. Its goal is to promote and contribute to regulatory and management solutions that ensure the integrity, attribution, and remuneration of these rights: the necessary creation of a licensing market that enables the legitimate authority of intellectual property holders to manage their works and contributions for AI uses, and to receive due compensation for the outputs generated by these models and systems.

The Observatory will also develop and compile studies and proposals regarding new forms of digital exploitation of protected works and contributions, capable of generating a legitimate return for their owners within the framework of legal digital offerings.

  • Legislation: laws and regulatory initiatives with worldwide scope (the Institute has already compiled a collection of legislation, licensing initiatives, and relevant jurisprudence on the protection and registration of AI-generated content and rights infringement related to this content worldwide).
  • Registration and protection criteria for AI-generated content
  • Jurisprudence, including monitoring of preliminary questions before the CJEU
  • Current developments: technological, creative community, economic and business, social… regarding AI developments and new digital exploitations
